Solid Waste Transporter Registration and Related Fees for Rail
Carriers, Proposed Amendments: N.J.A.C. 7:26-2B.1, 3.3, 3.5
and 4.1
Public Notice
Take notice that the NJ Department of Environmental Protection
(NJDEP) is proposing amendments to its solid waste management
regulations at N.J.A.C. 7:26-2B, 3, and 4. Subchapter 2B of
these regulations sets forth additional specific disposal requirements
for transfer stations and other solid waste facilities. Subchapter
3 of the solid waste regulations sets forth general requirements
for transporters of solid waste including vehicle and container
registration, employee training, vehicle design, and storage
restrictions, etc. Subchapter 4 sets forth the fees charged
by the Department for services rendered; it includes fees for
transporter related activities such as vehicle registration.
A statement of the substance of the proposal follows: NJDEP
is proposing amendments to exempt rail carriers from the need
to comply with the additional disposal requirements for transfer
stations; apply for and obtain approved registration statements
and register containers used to transport solid waste solely
by rail; and pay related transporter fees.
The proposal is scheduled to be published in the New Jersey
Register dated November 15, 2004. A copy of the proposal is
available from Westlaw Publishing at 1-800-808-WEST. Additionally,
a non-judicial copy of the proposal is available on the Division
of Solid & Hazardous Waste website. Be advised that
there may be a fee for obtaining a copy of the proposal from
some sources.
