Solid Waste Regulations, N.J.A.C. 7:26 and Recycling Rules,
N.J.A.C. 7:26A
Public Notice
Take notice that the NJ Department of Environmental Protection
is proposing an amendment to the Solid Waste Regulations, N.J.A.C.
7:26 and Recycling Rules, N.J.A.C. 7:26A. A statement of the
substance of the proposal follows:
Asbestos Ten-day Notification; N.J.A.C. 7:26-2.12, 2.13: The
Department is proposing to delete N.J.A.C. 7:26-2.12(b) which
requires generators of regulated asbestos containing material
to submit written notification to the Department 10 days prior
to the generators’ intent to demolish structures containing
asbestos materials since it is duplicative of several other
Federal and state agency notification requirements to which
generators of regulated asbestos containing materials are subject.
Regulated Medical Waste Annual Reports; N.J.A.C. 7:26-3A.21(d):
The Department is proposing to amend the Regulated Medical Waste
reporting requirements at N.J.A.C. 7:26-3A.21(d) to eliminate
the Annual Generator Report for generators of 200 pounds or
less of regulated medical waste per year. The Department has
compiled enough information from the reports that have been
submitted to understand the regulated medical waste generation
profiles for these small generators such that the annual filing
of these reports detailing the amounts generated are no longer
necessary.
Grass and Leaf Transfer Facility Exemptions; N.J.A.C. 7:26A-1.4(a)22:
The Department is proposing to relax buffer and visual screen
requirements for very small leaf and grass transfer sites accepting
less than 3000 yards of leaves and 1000 yards of grass per year.
This proposed amendment will create a new exemption from recycling
center general approval requirements and will apply to several
small municipalities collecting yard trimmings for transfer
to other recycling centers.
The proposal is scheduled to be published in the New Jersey
Register dated October 18, 2004. A copy
of the proposal may be accessed on the Division of Solid
& Hazardous Waste web site. Copies can also be obtained
from Westlaw Publishing at 1-800-808-WEST. Be advised that there
may be a fee for obtaining a copy of the proposal from some
sources.
