Notice of Rule Proposal
Freshwater Wetlands Protection Act Rules, N.J.A.C. 7:7A-11

Public Notice
Take notice that the NJ Department of Environmental Protection
is proposing amendments to the Freshwater Wetlands Protection
Act rules. A statement of the substance of the proposal follows:

The Land Use Regulation Program proposes to increase its freshwater
wetland application fees by approximately 20%.Some illustrative
examples: The fee for a Letter of Interpretation (“LOI”)
would increase from $200 to $240. A line verification LOI, one
acre or larger, would increase from $500 to $600, plus a per
acre fee increase from $70 to $84. The cap for all permit fees
will be $60,000, a 20% increase from the existing limit of $50,000.
Additionally, new fees are proposed for major development requiring
stormwater/water quality review in accordance with the Stormwater
Management rules (N.J.A.C. 7:8).

The proposal is scheduled to be published in the New Jersey
Register dated September 6, 2005. The proposal can be viewed

there may be a fee for obtaining a copy of the proposal from
some sources.
