Notice of Rule Proposal
Solid Waste Utility Control Rules, N.J.A.C. 7:26H & I

Public Notice
Take notice that the NJ Department of Environmental Protection
is proposing to readopt with amendments, new rules, and repeals
the solid waste utility control regulations. Amendments are proposed
for the following sections: N.J.A.C. 7:26H-1.4, 1.5, 1.6, 1.7,
1.8, 1.9, 1.12, 1.13, 1.20, 1.23, 3.1, 3.2, 3.6, 3.11, 4.2, 4.3,
4.4, 4.5, 4.6, 4.7, 4.8, 4.9, 5.1, 5.4, 5.5, 5.6, 5.7, 5.8, 5.9,
5.11, 5.12, 5.15, 5.16, 6.1, 6.3, 6.4, 6.5, 6.8, 6.9, 6.11, 6.13,
Appendix A. New rules are being proposed at N.J.A.C. 7:26H-5.17,
5.18, 5.19, 5.20, 5.21, 5.22, 5.23, 7.1, and 7.2. Furthermore,
the Department is proposing to repeal N.J.A.C. 7:26I in its entirety.
A statement of the substance of the proposal follows: The proposed
readoption with amendments and new rules will clarify provisions
of the regulations, and streamline them where possible. These
amendments delete references to uniform tariffs, reduce the frequency
of customer list submittals, establish procedural requirements
for obtaining host community benefit approvals, and codify statutory
penalty provisions and amounts. Additionally, the Department is
proposing to repeal the antiquated accounting system for solid
waste public utilities found at N.J.A.C. 7:26I.

The proposal is scheduled to be published in the New Jersey Register
dated May 20, 2002. A copy of the proposal is available from Westlaw
Publishing at 1-800-808-WEST. Be advised that there may be a fee
for obtaining a copy of the proposal from some sources.

Note: The comment period for this proposal has been extended
11 days until July 30, 2002 in accordance with the Notice of Extension
published by the Office of Administrative Law in the June 17,
