ENVIRONMENTAL REGULATION
WORKER AND COMMUNITY RIGHT TO KNOW
Notice of Special Adopted New Rules and Concurrent Proposed New Rules
Worker and Community Right To Know Program
Conversion from SIC Codes to NAICS Codes: Definition of Employer
(NJAC 7:1G-1)
Public Notice
Take notice that the NJ Department of Environmental Protection
is adopting temporary and concurrently proposing new rules in
accordance with N.J.S.A. 13:1D-138 et seq. The proposal will
amend the definition of “employer” in the Worker and
Community Right To Know Program rules at N.J.A.C. 7:1G to substitute
North American Industrial Classification System (NAICS) codes,
with certain exceptions and limitations, for Standard Industrial
Classification (SIC) codes. The conversion from SIC to NAICS
codes will ensure that the facilities currently regulated under
the program as identified by SIC codes will be identified instead
by NAICS codes, as required by the statute.
The proposal is scheduled to be published in the New Jersey
Register dated January 5, 2004. A copy of the proposal is available
from the Department’s web site at www.nj.gov/dep/opppc/reports.html; Peter Costanza, DEP Rule Manager (609)777-0518; or Westlaw Publishing
at 1-800-808-WEST. Be advised that there may be a fee for obtaining
a copy of the proposal from some sources.
