Notice of Determination to Not Adopt Limitation,
Modification, or Prohibition of Issuance of Authorizations

Take notice that the Department will not
adopt the proposed new rule and amendment to the Division of
Fish and Wildlife Rules, N.J.A.C. 7:25, which were published
on November 15, 2004, at 36 N.J.R. 5052(a).

The Department has determined, in light of the decision of
the New Jersey Supreme Court in U.S. Sportsmen’s Alliance
Foundation, et al. v. New Jersey Department of Environmental
Protection, et al., Docket No. A-69 (December 2, 2004), to
withdraw the rule proposal in order to consider what rulemaking,
if any, is needed to effectuate the decision of the court,
as well as to consult with the Fish and Game Council concerning
the formulation of comprehensive wildlife management policy.
