Opportunities for Public Comment

  • 1704-02-0001.11 LUP230001 – The New Jersey Economic Development Authority (“NJEDA”) has submitted an application to the Department’s Division of Land Resource Protection for a CAFRA Individual Permit, a Coastal Wetlands Permit, a Freshwater Wetlands Individual Permit, and a Flood Hazard Area Verification for the construction of Phase 1B of the New Jersey Wind Port on Block 26, Lots 4.02 & 5.02 in Lower Alloways Creek Township, Salem County. The work proposed under this application consists of the construction of an expanded laydown and marshalling area, the construction of a new light manufacturing facility for the assembly, testing, and storage of nacelles for offshore wind turbines, and the construction of a heavy haul road to provide a connection for the transportation of materials between parcels. The application is complete for the start of the public comment period, which will begin with publication in the DEP Bulletin on March 15th, 2023.

The work proposed under this application consists of the construction of a second marshalling port and associated manufacturing infrastructure in support of offshore wind development. The proposal includes both in-water and upland activities to prepare the site for use in construction, staging, vessel loading, and shipping of materials to offshore wind installation areas as well as manufacturing. The application also proposes the construction of a confined disposal facility (“CDF”) and the beneficial reuse of dredge material.

  • 0000-21-0008.4 LUP220001 – Ocean Wind, LLC has submitted an application for a CAFRA Individual Permit and a Freshwater Wetlands General Permit 12 for proposed geotechnical investigations associated with their Ocean Wind 1 project on properties located in Lacey Township and Ocean Township in Ocean County and in Ocean City, Cape May County. The geotechnical work consists of 44 soil boring to collect waste classification samples and 41 soil borings for soil characterization. Within 30 of the 41 soil characterization borings, 26 temporary well points and 4 monitoring wells will be installed to collect groundwater samples. The work also consist of the creation of three (3) test trenches. Portions of the work proposed under this application require a Coastal Wetlands Permit. The request to amend the application to add a Coastal Wetlands Permit application to the project was submitted on January 31, 2023. The Coastal Wetlands Permit application will be declared administratively complete once the application fee is received.

  • 0000-21-0008.2 LUP230001 – Orsted has re-submitted an application for a Coastal Wetlands Permit and a Waterfront Development Individual In-water Permit for their Ocean Wind 1 project which proposes the construction of a portion of their offshore wind farm within state waters and on land in Ocean and Cape May Counties. The overall work proposed under the application will consist of the installation of onshore and offshore cables as well as the construction of substations and grid connections as outlined in the application package. The CAFRA Individual Permit, Freshwater Wetlands Individual Permit, and Flood Hazard Area Verification Application for the Ocean Wind 1 project remain pending under DLRP file# 0000-21-0008.2 LUP220001. The portion of the offshore wind farm proposed outside of New Jersey state waters is being reviewed under a Federal Consistency Certification DLRP file# 0000-21-0008.1 CDT210001.

  • 0000-19-0011.1 WFD220001 – Ocean Wind, LLC (Ocean Wind) has submitted an application to modify Waterfront Development Individual In-water Permit No. 0000-19-0011.1 LUP190001, issued on August 02, 2019, which authorized the advancement of geotechnical survey borings within state waters in Great Egg Harbor Bay, and the Atlantic Ocean in order to inform the design of potential cable route options for potential offshore wind farms off the coast of New Jersey. The modification request consists of relocating geotechnical boring No. 24, along the HDD section of the south cable route (BL England), due to a change in the alignment of the proposed cable route.

      • Atlantic Shores Offshore Wind Federal Consistency Certification

        The Department of Environmental Protection has received a request for a Federal Consistency Certification from Atlantic Shores Offshore Wind, LLC to develop a commercial-scale, offshore wind energy facility within Lease Area OCS-A 0499 off the coast of New Jersey.

        The Project consists of the development of two offshore wind energy generation projects (Projects 1 and 2), including up to 200 wind turbine generators that will be located in federal offshore waters approximately 8.7 miles from the New Jersey shoreline within Bureau of Ocean Energy Management (“BOEM”) Lease Area OCS-A 0499 (“Lease Area”) as well as accompanying electric transmission cables from the Lease Area to two landfall points in Atlantic and Monmouth counties, respectively.

    0800-20-0002.1 FHA220001 & WFD220001 – Gloucester County Improvement Authority has submitted an application for major modifications of Flood Hazard Area Permit and Upland Waterfront Development Permit DLRP File# 0800-20-0002.1 LUP200001 which authorized the construction of a manufacturing facility at the Paulsboro Marine Terminal to support the construction of offshore wind farms. The submitted modification applications propose to relocate and reduce in size the proposed buildings and to revise the layout and location of the pavement and gravel areas. The proposed modifications also require revisions to the stormwater management system at the site.

    0800-07-0003.4 LUP220001 – South Jersey Port Corporation has submitted an application for a Flood Hazard Area Individual Permit, an Upland Waterfront Development Permit, a Freshwater Wetlands Transition Area Waiver Averaging Plan, and a Freshwater Wetlands Special Activity Transition Area Waiver for Redevelopment for the construction of the second phase of the offshore wind manufacturing facility at the Paulsboro Marine Terminal. This phase of the project will involve the construction of two fabrication buildings, drive aisles, parking, and stormwater management facilities.
  • 1300-22-0010.1 LUP220001 – Ocean Wind 2, LLC
    1300-22-0010.1 LUP220001 – Ocean Wind 2, LLC has submitted an application for a CZM General Permit 23 to conduct geotechnical investigations in the Atlantic Ocean and at two upland locations in Monmouth County, one in Asbury Park City and one in Long Branch City, to inform the design of potential cable route options for a potential 1,148 MW offshore wind farm off the coast of New Jersey within Lease Area OCS-A 0532. The geotechnical investigations will consist of approximately 114 sediment samples ranging in depths from 6 meters to 30 meters.
  • Offshore Wind Third Solicitation Draft Guidance Document

    The New Jersey Board of Public Utilities (“BPU” or “Board”) has released the draft solicitation guidance document (“SGD”) for its third offshore wind solicitation (“Third Solicitation”).

    The Third Solicitation is designed to help meet New Jersey’s clean energy goals, and to implement Governor Phil Murphy’s vision of making New Jersey a leading hub of offshore wind.  The Board seeks to promote robust competition in this Third Solicitation and future solicitations to support the continued development of the offshore wind industry in New Jersey.

    A virtual public stakeholder meeting to discuss the draft SGD will be held on December 13, 2022, and written comments will be accepted until Thursday, December 29, 2022. All public comments should be filed under Docket No. QO22080481. For more information, please see the Notice released by the BPU.

      • New York Bight Wind Energy Areas Offshore the States of New York and New Jersey Consistency Determination pdf

        The Department of Environmental Protection has received a request for a Federal Consistency Determination from the U.S. Department of the Interior, Bureau of Ocean Energy Management (BOEM) for the issuance of a lease or leases within the New York Bight Wind Energy Area offshore the State of New Jersey.

        The proposed action includes: Lease issuance, together with surveys for shallow hazards, geological, geotechnical, archaeological resources, and biological purposes; and, site assessment activities (including the installation and operation of meteorological buoys).

        The Department of Environmental Protection welcomes comments and any information that you may provide concerning the proposed Project by October 6, 2021.

  • 0102-22-0012.1, LUP220001 – Atlantic Shores Great Thorofare
    0102-22-0012.1, LUP220001 – Atlantic Shores Great Thorofare to conduct eight (8) sediment samples within Great Thorofare in Atlantic City, Atlantic County. This will include up to 4 boring sample locations with a maximum 6-inch radius and up to 4 cone penetrometer tests (CPT) with a maximum 1 ¾-inch radius. Four of the sampling locations will only include a soil boring with samples taken at regular depth intervals for analysis, and four of the sampling locations will only include a CPT sounding which will be advanced to a depth of approximately 150 feet.

Environmental Resources Offshore Wind Working Group

The New Jersey Environmental Resources Offshore Wind Working Group draws representatives from commercial and recreational fishing industries, conservation organizations, maritime industry, and fisheries councils. The Working Group will ensure that interested parties have a seat at the table with government officials to help shape the Murphy Administration’s offshore wind strategy and implementation.
